Welcome to Italiano Dinamico! These Terms and Conditions of Service ("Terms") govern your access to and use of the content and services offered through my Substack publication "Italiano Dinamico."

By accessing or using Italiano Dinamico, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use Italiano Dinamico.

1. Who I Am

Italiano Dinamico is a publication/newsletter/podcast I manage. You can contact me at: italianodinamico@proton.me.

2. Substack Platform

Italiano Dinamico is hosted and managed on the Substack platform. Your use of Italiano Dinamico is also subject to Substack's Terms of Service and their policies, which I encourage you to review: Substack TOS.

3. Subscriptions and Content

• Free Content: I offer free content (articles, podcasts) accessible to all users who subscribe to my newsletter.

• Paid Subscriptions (if applicable): I may offer paid subscription tiers that provide access to exclusive content or additional features. Details on paid subscriptions, including pricing, billing periods, and benefits, will be clearly indicated on my Substack page.

• No Guarantee of Availability: I strive to provide content regularly, but I do not guarantee the frequency or continuous availability of specific articles, podcasts, or features. Content production can be affected by various factors.

4. Payments and Renewals (if applicable for paid subscriptions)

• Billing: Payments for paid subscriptions will be processed via Substack and their payment service providers. You agree to provide accurate and complete payment information.

• Automatic Renewal: Paid subscriptions will automatically renew at the end of the subscription period unless you turn off auto-renewal before the renewal date.

• Price Changes: I reserve the right to change subscription prices. I will inform you with reasonable notice of any price changes.

• No Refunds for Digital Content: As the content offered (podcasts, articles) is digital in nature and provided immediately upon purchase/access, refunds are not available for paid subscriptions. By purchasing a subscription, you acknowledge and agree to waive your right of withdrawal once the digital service has commenced.

• Easy Unsubscription: You can unsubscribe from your paid subscription at any time with a single click by logging into your Substack account and managing your subscription settings. Unsubscribing will prevent the automatic renewal of your subscription at the end of the current billing period, but it will not entitle you to refunds for any period already paid.

5. User Conduct

You agree to use Italiano Dinamico responsibly and lawfully. In particular, you agree not to:

• Use Italiano Dinamico for any illegal or unauthorized purpose.

• Distribute or reproduce the content of Italiano Dinamico without my explicit authorization, except for personal, non-commercial use (e.g., sharing links to posts or short excerpts with proper attribution).

• Any digital files (e.g., PDFs) provided through Italiano Dinamico may only be used and printed for personal and/or educational purposes (such as individual study, use in schools, universities, libraries, etc.). It is strictly prohibited to use such files for commercial purposes or to distribute them to third parties outside the personal/educational scope specified here.

• Upload, post, email, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

• Attempt to gain unauthorized access to Substack's or Italiano Dinamico's systems or networks.

• Interfere with or disrupt the service or servers or networks connected to the service.

6. Intellectual Property Rights

All content published on Italiano Dinamico, including text, graphics, logos, images, audio (podcasts), video, and software, is my property or that of my licensors and is protected by copyright and other intellectual property laws.

Subscription to Italiano Dinamico grants you the right to access and view/listen to the content for your personal, non-commercial use. You may not modify, publish, transmit, create derivative works from, or in any way exploit, any of the content, in whole or in part, without my prior written permission.

7. Disclaimer of Warranties

Italiano Dinamico is provided "as is" and "as available," without warranties of any kind, either express or implied. I do not warrant that:

• Italiano Dinamico will be uninterrupted, secure, or error-free.

• The content will be accurate, complete, or reliable.

• Any defects will be corrected.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Italiano Dinamico and its owner, affiliates, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, or goodwill, arising out of your access to, or use of, or inability to access or use, Italiano Dinamico.

9. Indemnification

You agree to indemnify and hold harmless Italiano Dinamico, its owner, affiliates, licensors, and service providers from any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of Italiano Dinamico or your violation of these Terms.

10. Changes to the Terms

I reserve the right to modify these Terms at any time. I will notify you of any changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of Italiano Dinamico after the posting of modified Terms will constitute your acceptance of such changes.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Italy, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the consumer's place of residence or domicile, if located within the territory of Italy.
